BE CHARGE APP: TERMS AND CONDITIONS
GENERAL TERMS AND CONDITIONS
These general contract conditions (“General Conditions” or “Contract”) govern the terms and conditions of the “BE CHARGE” services (“Services” and each individually “Service”) provided by BE CHARGE S.R.L. VAT: 09957510960; with registered office in Milan Via Carlo Bo no. 11 email/PEC: bechargesrl@legalmail.it telephone number 0237929489 (“BE CHARGE” or “BEC”) through the BE CHARGE app (“App”) to customers. To access the Services, it will be necessary to enter billing information and a valid payment method in the App, possibly also registering as a customer of the Service (“Customer” or “User”) according to the instructions provided in the subsequent point “Registration and Subscription to the Service” upon acceptance of these General Conditions. The Customer acknowledges that the prices for the use of the Services are identified in the document “Annex 1: Rates for the use of Services through BE CHARGE APP” (“Rates”) attached to these General Conditions and an integral and substantial part of them available at the following link https://www.bec.energy/termini-e-condizioni-tariffe/. The General Conditions will also apply to any new Services that may be provided in the future to Customers upon their acceptance.
1. OBJECT OF THE CONTRACT
1.1 The object of this Contract consists in the provision by BE CHARGE of the following Services through the App:
a) Charging of the electric vehicle at public charging stations (“Charging Service”) of BEC (“BEC Charging Stations”) and/or third-party operators (“Third-Party Charging Stations” collectively BEC Charging Stations and Third-Party Charging Stations “Charging Stations”) compatible with the Service which the Customer can access via the App or through the associated RFID card;
b) Viewing on a map the Charging Stations dedicated to electric vehicles compatible with the Service provided by BE CHARGE;
c) Setting preferred Charging Stations by the Customer;
d) Reservation of the socket at a Charging Station for a predefined time interval before unlocking and starting the charging process at the selected Charging Station;
e) Unlocking the single socket and starting the charging process at the selected Charging Station also through the use of the RFID card associated with the profile;
f) Monitoring the charging process for BEC Charging Stations and Third-Party Charging Stations where available;
g) Interrupting the charging process via the dedicated button on the App or through the RFID card associated with the profile;
h) Notification of the end of the free parking period (the period of occupation of the Charging Station and the related parking area that starts when the use of the Charging Service ends until the penalty application as defined in Article 5) upon setting by the Customer of the intention to receive notifications via App;
i) Purchase and association of an RFID card to the profile;
j) Automatic payment of the Service fee according to the methods pre-set by the Customer in their profile;
k) Archiving and viewing in a dedicated section of the history of charging sessions and invoices received;
l) Subscription and modification of the Customer’s Tariff Plan;
m) Modification of personal data and payment method associated with the profile;
n) Association of multiple profiles to the same account. Each profile will be characterized by a dedicated Tariff and/or a dedicated view of the Charging Stations it can access. BEC will identify these profiles by associating a unique code in the profile creation section of the App or website.
1.2 BE CHARGE reserves the right to activate some of the Services also at a later stage after signing this Contract.
1.3 The Customer for each use of the Service and for the entire duration of the Contract is obliged to comply with and observe the provisions contained in these General Conditions and the related annexes.
2. REGISTRATION AND SUBSCRIPTION TO THE SERVICE
2.1. Access to the Service can occur:
- following specific registration of the Customer through the App for smartphones. The instructions for registering and subscribing to the Service are available in the “How It Works” section and for more details in the “Frequently Asked Questions” section both on the App and on the BE CHARGE website. By completing the registration process and clicking on the “Accept” button, the Customer declares to have carefully read and expressly accepted these General Conditions, its annexes, and the privacy policy;
- without prior registration on the App by entering only billing information and the payment method at the time of Service provision. To use the Service, these General Conditions, its annexes, and the Privacy Policy must be accepted. The instructions for accessing the Service without registering are available in the “How It Works” section and for more details in the “Frequently Asked Questions” section both on the App and on the BE CHARGE website. These General Conditions and, if applicable, the document “Annex 1 – Rates for the use of Services through BE CHARGE APP” will also apply to those who decide to access without prior registration on the App.
2.2. Customers who want to use the Services without registering can, after entering the necessary payment and billing information, use only the following Services:
- a) charging the electric vehicle at public Charging Stations compatible with the Service which the Customer can access via the App exclusively with the application of the Pay-As-You-Go Rate as defined pursuant to Article 3 of Annex 1: Rates for the use of services through the BE CHARGE App;
- b) viewing on a map the Charging Stations dedicated to electric vehicles compatible with the Service provided by BE CHARGE;
- c) viewing the itinerary to reach the selected Charging Station;
- d) unlocking the single socket and starting the charging process at the selected Charging Station;
- e) monitoring the charging process for BEC Charging Stations and Third-Party Charging Stations where available;
- f) interrupting the charging process via the dedicated button on the App.
2.3. The activation of the Charging Service is in any case subject to the successful verification by BE CHARGE of the payment method entered at the time of subscribing to the Service. For accepted payment methods, see Article 6.
2.4. Subscription to the Service is allowed only to those over the age of 18 and to VAT holders.
3. MODIFICATION OF SERVICES AND GENERAL CONDITIONS AND RATES
3.1. BE CHARGE reserves the right to update, integrate, and/or modify the Services and these General Conditions for justified reasons including: (a) reasons of public interest and/or safety; (b) reasons related to the correct fulfillment of legislative and/or regulatory obligations; (c) reasons related to legislative and/or regulatory changes; (d) reasons related to the implementation of updates and technical improvements to the Services and the App including any technical update of the App; (e) reasons related to the improvement or modification of the Services; (f) reasons related to the conception and creation of new services by BE CHARGE; (g) technical, organizational and/or commercial reasons that make changes necessary without which BE CHARGE would be unable to continue providing the Services subject to these General Conditions; (h) reasons related to changed market conditions.
3.2. Updates to these General Conditions will be communicated with a notice of 14 (fourteen) days (“Notice Period”) through direct communication to the Customer at the email address provided by the same during registration and/or subscription to the Service. Once the Notice Period has expired without the Customer’s withdrawal, the changes will be deemed effective and will be published on the site https://www.bec.energy/be-charge-app-termini-e-condizioni/ and through in-app communication.
3.3. For changes and updates to the Rates, see the document “Annex 1: Rates for the use of Services through BE CHARGE APP”.
3.4. In case of any integration, update, and/or modification of these General Conditions including changes to the Rates, the Customer will have the right to withdraw from these General Conditions as better detailed in the following Article 4 and in compliance with the Notice Period.
3.5. It is understood that if the Customer withdraws following the modification/integration/update of these General Conditions or Rates, they will have the right to continue using the Services until BE CHARGE proceeds with the account cancellation as better established in the following Article 4.
3.6. The Customer acknowledges and agrees that the changes, integrations, and/or updates to these General Conditions will be deemed expressly accepted by the Customer if the latter does not withdraw from these General Conditions within the Notice Period, i.e., within 14 (fourteen) days from the communication sent by BE CHARGE as referred to in the previous Article 3.2.
4. DURATION, WITHDRAWAL, TERMINATION
4.1. This Contract is concluded when it is accepted by the Customer and is for an indefinite period.
4.2. The Customer, following registration or subscription, may in any case exercise the right of withdrawal within 14 days from subscribing to this Contract (“Withdrawal Period”).
4.3. Following their express consent and acknowledgment, the Customer who intends to start using the Services during the Withdrawal Period will be required to pay for the Services already provided as indicated in the document “Annex 1: Rates for the use of Services through the BE CHARGE APP”.
4.4. If the Customer purchases a prepaid card or “wallet” (as defined below in Article 5) and exercises the right of withdrawal within the Withdrawal Period from purchase, BE CHARGE will refund the amount paid to purchase the prepaid card or “wallet” provided it has not been used in the meantime (in whole or in part). The Customer will not be refunded if they exercise the right of withdrawal after the Withdrawal Period.
4.5. Regarding the Rates for exercising the right of withdrawal, the provisions of the document “Annex 1 – Rates for the use of Services through BE CHARGE APP” apply.
4.6. The right of withdrawal may be exercised by the Customer by sending an unambiguous communication to support@bec.energy or by completing the withdrawal form available at the following link https://www.bec.energy/be-charge-app-recesso/ and sending it in the manner described therein.
4.7. The Customer may withdraw from this Contract by sending an unambiguous communication to support@bec.energy at any time. The withdrawal will be effective upon receipt of the communication by BE CHARGE, without prejudice to the obligation for the Customer to pay for the Services already used and to comply with the obligations arising from the Contract and related annexes.
4.8. BE CHARGE may terminate the Contract, with the immediate suspension of Services without prior notice in case of: a) breach by the Customer of one or more provisions of this Contract; b) non-payment by the Customer of the amounts due; c) fraudulent use of the Services by the Customer or actions that could harm the reputation of BE CHARGE; d) cases of force majeure as defined in Article 10; e) situations that make it impossible to continue providing the Services for technical, organizational, or commercial reasons.
4.9. In case of termination of the Contract by BE CHARGE as per the above points, the Customer will be notified through the App and by email, if applicable, and will not have the right to any compensation.
4.10. BE CHARGE shall have the right to terminate this Agreement with immediate effect pursuant to Article 1456 of the Italian Civil Code in the following cases:
- The Customer is in breach of its payment obligations; or
- The Customer uses the Service in violation of these General Terms and Conditions and/or applicable laws and regulations and/or for illegal purposes, in particular for the violation of the following clauses: Article 6; Article 9; Article 11; Article 13.
4.11. Without prejudice to the provisions of Article 4.8 above, BE CHARGE shall have the right to terminate this Agreement pursuant to Article 1454 of the Italian Civil Code, subject to a notice to comply within a minimum period of 15 days.
4.12. BE CHARGE shall also have the right to suspend the Service, after notifying the Customer, in case of non-payment or partial payment of the consideration for even a single invoice issued and unpaid. The Service and billing will be reactivated upon settlement of all outstanding invoices.
5. SERVICE UTILIZATION AND EXTRA-PARKING FEE
5.1. Registration and/or use of the BE CHARGE App by the Customer is free of charge.
5.2. Utilization of the Services by the Customer requires payment of a consideration for the Charging Service based on the Tariffs chosen by the Customer. The economic conditions of the different Tariffs made available to the Customer are described in detail in the document entitled “Annex 1 – Tariffs for the Utilization of Services via BE CHARGE APP”, attached to this Agreement and available at the following link: https://www.bec.energy/terms-and-conditions-tariffs/
5.3. The Customer may not occupy the BEC Charging Stations and the associated parking area for a period exceeding the one indicated in the App as “free parking”, after which an extra-parking fee will be applied to the customer. The “free parking” period starts when energy delivery from the Charging Station ends and lasts for 60 minutes. In the case of Quick charging stations with a power output up to 22 kW, the extra-parking fee for exceeding the “free parking” period does not apply during nighttime hours, i.e., from 11 PM to 7 AM.
5.4. At the end of the “free parking” period, the time occupying the BEC Charging Station relevant for the application of the extra-parking fee starts from the end of the “free parking” period as defined above in Article 5.3 until the connector is removed from the utilized Charging Station.
5.5. The extra-parking fee applied to the Customer for BEC Charging Stations is calculated by applying a fixed fee for each minute of occupation of the Charging Station and the associated parking area. The fixed fees vary depending on the type of connector used and are listed below:
Quick (AC up to 22kW) 0.12€/min
Fast (DC up to 99kW) 0.20€/min
Fast+ (DC up to 149kW) 0.30€/min
Ultrafast (DC over 150kW) 0.30€/min
5.6. BE CHARGE reserves the right to apply the extra-parking fee described above also in the case of charges performed with a power output below the Minimum Power Level as described in Article 11.
5.7. The start time of the charge is viewable in real-time on the App in the ongoing charge screen and, at the end of the charging session, also in the “Activity – History” section.
5.8. Non-payment of the extra-parking fee may result in the suspension and/or termination of the Agreement pursuant to Article 4, and the related amounts will be recovered by BE CHARGE according to the law.
5.9. With regard to Third-Party Charging Stations, the conditions and amounts for the application of the extra-parking fee or penalties for occupying the respective parking areas beyond the terms are defined by the operators who own the charging station.
6. BILLING AND PAYMENTS
6.1. The invoice shows the charges and/or any credits, specifying the related Services used. The invoice is issued in digital format and sent to the email address indicated in the billing profile and stored in the “invoice history” section of the App. Payment can be made through the App, using the acceptable payment methods indicated below and in the payment section of the App. The charge to the Customer’s account for the amount due to BE CHARGE is made at the time of the completion of the Service. The invoice will show the charges and/or any credits, specifying the related Services used.
6.2. The billing frequency varies depending on the Tariff selected by the Customer, as described in more detail in the document “Annex 1 – Tariffs for the Utilization of Services via BE CHARGE APP”, attached to this Agreement.
6.3. The payment method is specific to each profile linked to the account and is associated with the billing profile as completed by the user. For all Customers, the payment method associated with their billing profile at the time of joining the Service is considered the automatic payment method for the Service.
6.4. The accepted payment methods are as follows:
- Credit or debit card with VISA and MASTERCARD networks;
- Prepaid card or “wallet”, a tool provided by BE CHARGE that allows the crediting of a sum of money to be used for the utilization of the electric charging service (as defined in the document “Annex 1 – Tariffs for the Utilization of Services via BE CHARGE APP”) at BEC Charging Stations and/or, depending on the cases identified in the App, at Third-Party Charging Stations with which BE CHARGE may have entered into an interoperability agreement.
6.5. Regarding the prepaid card or “wallet”, the Customer can purchase various denominations:

6.6. The expiration date is 6 months from the date of purchase and will be displayed in the App at the time of purchase. The wallet can be recharged directly in the App with a credit card.
6.7. Other prepaid cards with different denominations and expiration dates may also be available and can be provided by BE CHARGE or third parties directly to the Customer.
6.8. Upon expiration as indicated in the App, any remaining and unused credit on the wallet will be zeroed, will no longer be usable, and will not be refunded. It is always possible to purchase an additional wallet whose credit will contribute but not cumulate with the credit of another wallet already present. In the case of the presence of multiple wallets, the payment system of the App will prioritize the credits closest to expiration.
6.9. If the payment for the Service fails, BE CHARGE will notify the Customer of the non-payment, suspending the Service until the outstanding amount is settled.
6.10. The RFID Card is a method to start/stop the Charging Service and allows the Customer to start and stop charging following the Tariff of the profile it is associated with. The RFID Card is associated with the same payment methods as the App, as described in Article 4. The Customer can purchase it in the appropriate section of the App. To be activated, the RFID Card must be associated with a Customer profile via the App.
7. DISCOUNT COUPONS
7.1. The Customer can benefit from specific discount schemes offered by BE CHARGE, or by its partners or third parties, for example through the assignment of Coupons/Vouchers, activation of a specific promotion, or through the use of Gift Cards. The discount services are better described in the specific terms and conditions of the relevant promotion.
8. DISCLAIMER OF LIABILITY
8.1. To the maximum extent permitted by applicable law, excluding cases of willful misconduct or gross negligence by BE CHARGE, or in the event of death or personal injury caused by an action or omission of BE CHARGE, the latter shall not be liable for direct or indirect damages of any kind that the Customer or third parties may suffer in any way due to the Service, which are not attributable to BE CHARGE, or due to changes in the methods, schedules, and/or conditions of Service delivery, as well as due to suspension, interruption, or otherwise unavailability of the Service itself, dependent on vehicles, technological devices, telecommunication computer systems, and any cause attributable to third parties.
8.2. With reference to the map display of Third-Party Charging Stations, BE CHARGE shall not be liable for any damages resulting from the inaccurate geographic identification of Third-Party Charging Stations, nor for any direct or indirect damages resulting from their use, which remain the exclusive responsibility of the third-party provider.
8.3. Furthermore, BE CHARGE’s liability is excluded for total or partial non-performance of its obligations due to force majeure such as, but not limited to: acts of the State and Public Administration, acts of Public Authority, legal limitations, fires, floods, explosions, mobilizations, riots, strikes, industrial disturbances, lack of electricity, interruption of telephone lines, lack of fuel oils and others.
8.4. The Customer, in any case, to the maximum extent permitted by applicable law, expressly exempts BE CHARGE from any liability, except in cases of personal injury, for any damages of any kind suffered by the Customer and/or third parties in relation to the execution of the Agreement, not deriving from willful misconduct or gross negligence of BE CHARGE, but attributable to the willful misconduct or gross negligenceof BE CHARGE, but attributable to the willful misconduct or gross negligence of the Customer and/or third parties.
9. AMENDMENTS AND ADDITIONS
9.1. BE CHARGE reserves the right to make amendments and/or additions to these General Terms and Conditions, which will be published on the website www.bec.energy.
9.2. The amendments and/or additions will be effective from the time they are made available through publication. The Customer, who does not agree with the amendments and/or additions made, may terminate the Agreement without penalty by giving written notice to BE CHARGE within 15 (fifteen) days from the date of their publication.
9.3. Failure to communicate withdrawal in the manner indicated in Article 9.2 will result in the Customer being considered to have accepted the amendments and/or additions.
10. COMMUNICATIONS
10.1. All communications between the parties regarding the execution of this Agreement must be made in writing and sent by email, registered letter with return receipt, certified mail (PEC), or other legally accepted means of communication to the addresses indicated in the registration form or otherwise communicated.
11. MINIMUM POWER LEVEL
11.1. The minimum power level at which the Customer is considered to be using the Service is 2 kW.
11.2. For the correct use of the Charging Service, the Customer must set a minimum threshold of instantaneous power that can be absorbed by the vehicle of at least 1 kW (“Minimum Power Level”). BE CHARGE reserves the right to terminate these General Conditions, as detailed in Article 4.10 above, and apply the extra-stay fee referred to in Article 5 above in the case of recharges performed with a power level below the Minimum Power Level.
11.3. The maximum Power Level indicated on the App may not be effectively delivered due to technical reasons such as, by way of example and not exhaustive, network congestion or other technical reasons related to the vehicle, battery condition, charging infrastructure, or network connection.
11.4. It is understood that BE CHARGE will not be held responsible for any power deliveries that are below the maximum Power Level, even if this is indicated or estimated on the App.
12. PROCESSING OF PERSONAL DATA
12.1. For the purposes of subscribing to and using the Services, it may be necessary to process the Customer’s personal data. BE CHARGE undertakes to carry out such personal data processing in compliance with the applicable data protection legislation, including Regulation (EU) 2016/679 (“GDPR”), and based on the Privacy Policy available in the relevant section of the App. The processing of Customers’ personal data will be based on what is communicated in the information on the processing of personal data provided pursuant to Article 13 of the GDPR.
13. INTELLECTUAL PROPERTY RIGHTS
13.1. The Customer expressly acknowledges that all intellectual and/or industrial property rights, including, by way of example and not exhaustive, know-how, source code, software, hardware, designs, applications, patents, industrial secrets, formulas, algorithms, models, databases, trademarks, designs, and the like, related to the Services, the App, the BE CHARGE website, the data and other materials provided by BE CHARGE or made available to the Customer by BE CHARGE under this Contract are and remain the exclusive property of BE CHARGE and the entities for which it is the legitimate licensee.
13.2. The Customer is expressly prohibited from reproducing, copying, modifying, selling, transferring, licensing, assigning, transferring to third parties, and/or creating derivative works from any intellectual and/or industrial property right of BE CHARGE, nor allowing third parties to do so through the Customer or their electronic device and BE CHARGE account. The Customer also acknowledges that all content (e.g., software, images, graphics, photographs, music, sound, video, text, data, etc.) in promotional correspondence between the Customer and third parties advertising their products via the “web mail” service are protected by copyright laws, trademarks, service marks, patents, or other proprietary rights and laws. Some areas of the App implement Google Maps mapping services, including Google Maps application programming interfaces (APIs). The use of Google Maps by the Customer is subject to the terms and conditions of Google Maps services.
14. APPLICABLE LAW AND JURISDICTION
14.1. These General Conditions are subject to the current Italian law. The application of more favorable and mandatory provisions of the law of the country in which the Customer, who is also a consumer as defined in the Consumer Code, has their habitual residence is reserved.
14.2. In compliance with current regulations (Legislative Decree No. 206/2005 and subsequent amendments – “Consumer Code”), in the case of a Customer who is also a consumer as defined in the Consumer Code, for any dispute relating to the application, execution, and interpretation of this Contract, the court of the place where the Customer resides or has elected domicile is competent. For all other cases, the Court of Milan is competent.
15. ALTERNATIVE DISPUTE RESOLUTION
15.1. BE CHARGE informs the Customer who is also a consumer as defined in the Consumer Code that, if they have submitted a complaint to BE CHARGE, and it was not possible to resolve the dispute, they may refer the resolution of the dispute amicably through conciliation to RisolviOnline, an independent and institutional service provided by the Arbitration Chamber of the Chamber of Commerce of Milan. For more information on the RisolviOnline regulation or to submit a conciliation request, the Customer who is also a consumer as defined in the Consumer Code can visit the site risolvionline.com.
15.2. In addition to the provisions of Article 15.1. above, BE CHARGE also informs the Customer who is also a consumer as defined in the Consumer Code that a European platform for online consumer dispute resolution (so-called ODR Platform) has been established. The ODR Platform is accessible at the following address: http://ec.europa.eu/consumers/odr/. Through the ODR Platform, the Customer who is also a consumer as defined in the Consumer Code can consult the list of ADR entities, find the link to the website of each of them, and initiate an online dispute resolution procedure in which they are involved. The BE CHARGE email address to be indicated on the ODR Platform is: bechargesrl@legalmail.it.
15.3. The Customer who is also a consumer as defined in the Consumer Code residing in a member state of the European Union other than Italy, may also access, for any dispute relating to the application, execution, and interpretation of these General Conditions, the European procedure established for small claims, by Council Regulation (EC) No. 861/2007 of July 11, 2007.
15.4. The rights of Customers who are also consumers as defined in the Consumer Code to bring a claim before the competent ordinary judge for any dispute arising from these General Conditions, whatever the outcome of the out-of-court settlement procedure, and to promote an out-of-court resolution of disputes, if applicable, by using the procedures referred to in Part V, Title II-bis of the Consumer Code, titled “Out-of-court resolution of disputes”, are in any case reserved.

16.2. BE CHARGE will respond to complaints via email within 5 working days from the date of the complaint.
UNFAIR TERMS
17.1. The parties expressly declare to accept the content of Articles 2, 3, 4, 5, 6, 8, 10, 11; 14, 15.
ATTACHMENT 1: RATES FOR USING SERVICES VIA BE CHARGE APP
This document, attached to the General Conditions that regulate the use of the Services provided to its customers by BE CHARGE S.R.L. (“BE CHARGE” or “BEC”) through the App, describes and regulates the various rates (“Rates”) for the use of the electric vehicle charging service (“Charging Service”) at BEC public charging stations (“BEC Charging Stations”) or compatible third-party operators (“Third-Party Charging Stations”, collectively BEC Charging Stations and Third-Party Charging Stations, “Charging Stations”), which the Customer can access via the App or through the associated RFID card.
1. DEFINITIONS
1.1. In this document, words and expressions indicated with a capital letter, unless otherwise defined, will have the meaning attributed to them within the General Conditions of which this document is an Attachment and is an integral and substantial part.
2. RATES FOR THE USE OF THE CHARGING SERVICE
2.1. The use of the Charging Service requires the payment of a fee based on the Rate chosen by the Customer. This fee is all-inclusive and includes all costs related to the Customer’s use of the Service and any taxes for which the applicable legislation provides the right of recourse.
PAY-PER-USE RATE
3.1. The pay-per-use rate corresponds to the price in € (or other currency)/kWh that is applied to the Customer for the use of the Charging Service at the Charging Stations (“Pay-Per-Use Rate”).
3.2. The amount charged to the Customer for the use of the Charging Service is calculated by multiplying the kWh delivered by the Pay-Per-Use Rate published in the App concerning the Charging Station chosen by the Customer. The Pay-Per-Use Rate may vary depending on the type of plug chosen by the Customer from the various options available, namely Quick (AC), Fast (DC), Fast+ (DC), and Ultrafast (DC) and from the Charging Service operator in the case of a Third-Party Charging Station.
3.3. The Pay-Per-Use Rate applied for the use of the Charging Service may vary depending on the Charging Station chosen by the Customer from those available in the App. In this regard, it should be noted that the amount of the Pay-Per-Use Rates applied for the use of the Charging Service at Third-Party Charging Stations is nevertheless defined by BE CHARGE: this amount may differ i) from the Pay-Per-Use Rate applied for the use of the Charging Service at BEC Charging Stations; and ii) from the rates applied by other operators for recharges performed at their Charging Stations.
4. RATE CHANGES
4.1 BE CHARGE reserves the right to update, supplement, and/or modify this document for justified reasons, including: (a) reasons of public interest and/or safety; (b) reasons related to compliance with legislative and/or regulatory obligations; (c) reasons related to legislative and/or regulatory changes; (d) reasons related to the implementation of updates and technical improvements to the Services and the App, including any technical updates of the App; (e) reasons related to the improvement or modification of the Services; (f) reasons related to the creation and development of new services by BE CHARGE; (g) technical, organizational, and/or commercial reasons that make modifications necessary without which BE CHARGE would be unable to continue providing the Services covered by these General Conditions; (h) changed market conditions.
4.2 Updates to this document will be communicated, with 14 (fourteen) days’ notice (“Notice Period”), by publication on the website https://www.bec.energy/be-charge-app-terms-and-conditions/, and through notification in the App, and by direct communication to the Customer at the email address provided during registration and/or subscription to the Service.
5. BILLING FREQUENCY
5.1. For charges made with the application of the Pay-Per-Use Rate, the invoice is issued and sent to the Customer at the end of each charging session and includes the fees due for the use of the Charging Service and any extra costs due for the payment of penalties applied pursuant to art. 5.5 of the General Terms and Conditions.
5.2. The payment method is specific to each profile linked to the account. For all customers, the payment method associated with their account at the time of subscribing to the Service or, in any case, the one indicated within the Customer’s profile is the usual payment method for the Service. See article 6.4 of the General Conditions for details.
5.3. The details of the Rates will be available in the appropriate section of the App and in the same section, the Customer can change, for each profile linked to the account, the Rate without any cost or constraint.
